Time Sensitive: Covid MOU for AY 2022-20223

Dear Western faculty,As we head into Fall Quarter, we wanted to inform you that the United Faculty of Western Washington and Western Washington University have signed a <a href="https://www.ufww.org/bufww/wp-content/uploads/2022/08/2022-08-30-UFWW-WWU-Covid-MOU-11.pdf">Covid-related Memorandum of Understanding for AY 2022-2023</a>.Both the UFWW and the administration agree that so long as SARS-COV2 transmission and its social effects impact faculty health, safety, workload, or evaluation, such agreements may continue to be necessary. In other areas, we share the goal of ensuring that the University operates, as much as practicable, under its regular procedures. Here are a few details from the agreement:Covid protections remain in place for vulnerable faculty. Most importantly, faculty who need to teach hybrid or online for reasons of their health, that of members of their household, or others with whom they are in close contact, will continue to be able to make requests to HR. Faculty with other Covid-related reasons for needing to teach online or hybrid may also apply to HR. These requests should be made as soon as possible, no later than September 16. Course modality is generally the province of faculty governance, not collective bargaining. As a result, except for Covid-related circumstances that result in faculty members being approved for online or hybrid instruction, faculty should be teaching in the modalities approved by ACC. We have maintained the two-week Covid-related modality change. If you, members of your household, or members of your class get Covid, you may switch to an online or hybrid modality without approval. Dear WWU Faculty Members,The Elections Committee of the United Faculty of Western Washington asks you to mark Friday, May 20th from 9:30-10:30am on your calendars for the UFWW Annual Meeting, which will be held via Zoom. We also heartily encourage all members to nominate themselves or another member for a position on the UFWW Executive Committee starting in Fall 2022. The window for nominations is now open and will close at the conclusion of the Spring meeting (May 20th). Balloting will be done electronically during Finals Week (June 6th-9th).All faculty (tenured, tenure-track, and non-tenure-track) who are members of UFWW are welcome to nominate themselves or another member for an open position. The Elections Committee is seeking nominees for the following positions: President, Vice President, Treasurer, and one At-Large position. We're happy to talk to anyone interested in a particular position about the details of it. UFWW Update -- Spring and Summer 2022 MOU

Many thanks to Vicki Hsueh and Matt Roelofs for their work on this (and other) MOUs. Talk soon, TW---</div><div style="-webkit-text-stroke-width: 0px; text-align: start;"> </div><div style="-webkit-text-stroke-width: 0px; text-align: start;">Memorandum of UnderstandingbetweenWestern Washington UniversityandUnited Faculty of Western Washington Modality 1. For the Spring and Summer 2022, all faculty members can choose instructional modality, whether in-person, hybrid, or remote. Faculty who choose in-person or hybrid modalities do not need to seek approval. Faculty who wish to teach remotely can make requests based on the criteria below.  If a faculty member chooses remote instruction for one of the following reasons, their request should be sent to Human Resources:  a. Faculty who have approved medical or religious exemptions from COVID-19 vaccination requirements;b. Faculty who are immunocompromised or otherwise at high risk as determined by their health care provider, whether or not they are vaccinated;c. Faculty who anticipate having unvaccinated, immunocompromised, or otherwise high-risk individuals in their household; If a faculty member chooses remote instruction for one of the following reasons, their request should be sent to the Provost’s Office: d. Faculty whose travel circumstances preclude in-person teaching (e.g., residence out of state);e. Faculty whose personal health situation or health situation of their household makes them uncomfortable with in-person instruction;f.  Other personal or professional reasons to prefer remote instruction. For requests that rely on a rationale based on items (a), (b), or (c), HR will approve or deny the request. For requests that rely on a rationale based on items (d), (e), or (f), a panel composed of one representative from the Provost’s Office and one representative from UFWW will evaluate the request using a blind review process and approve or deny the request. If the panel deadlocks, the request will be approved. 2. If a request is denied under items (a), (b), or (c) above, the faculty member can opt to have their request reviewed under items (d), (e), or (f) above. 3. No averse action will be taken against any faculty member making such a request, even if that request is denied. 4. Faculty do not need to request permission to move from in-person or hybrid to remote for two weeks or less due to disruptions related to COVID 19 including faculty isolation or quarantine, to care for someone who must isolate or quarantine or otherwise stay home, or if a significant number of students in the class must isolate or quarantine. If doing so, faculty should notify their students and chair. 5. Faculty will make initial requests for modality changes for Spring by 4 February 2022. Those for Summer should be made by 18 April 2022. Emergent requests after these dates will be evaluated using the same process.  Safety 6. The University will comply with the American Society of Heating, Refrigerating and Air-Conditioning Engineers’ (ASHRAE) recommendations for maintaining healthy buildings, including maximizing fresh air intake, minimizing cross-flow of air in occupied spaces, and optimizing system filtration to the greatest extent possible. The university will provide all available data on: (1) real-time monitoring of supply air and exhaust rates on all air handlers to ensure that ASHRAE standards for supply air are achieved, (2) the approximately 130 CO2 monitoring points in building supply air systems to ensure air provided to large sections of buildings contains sufficient outside air (OSA), and (3) the approximately 100 CO2 monitoring points in individual lecture halls and GUC’s to verify that the overall ventilation strategy is effective. This data will be provided by March 1, 2021 (via a webpage or email) and will be updated if the ASHRAE  recommendation is not met. The University will continue the use of  MERV 13 air filters where system design and operating capacity allows and complete routine scheduled maintenance of all HVAC systems to ensure proper operation. Any building or room that falls below the ASHRAE recommendations will be taken offline or marked as for limited use. For buildings without supply air systems, the University will implement site-specific solutions within one week. 7. The University will provide faculty with vaccination rate information (including information on boosters, if available) for their classes 1 week prior to the first day of class and will update that information if it changes during the course of the quarter. 8. Faculty will not be required to clean / disinfect rooms or elements of instructional spaces. The University will follow all health guidance and best practices with regards to cleaning and sanitation. 9. Faculty will have access to their workspaces even if they teach remotely, assuming state guidance permits.  10. The University will provide supplies and equipment including disposable masks, disinfectant, and disinfectant wipes in departmental spaces and classrooms. These materials will be restocked as needed upon notification. 11. The University will notify faculty of positive cases of COVID-19 in their classes within 24 hours of receiving notification.  12. The University will make COVID-19 testing available on a voluntary basis to vaccinated faculty, including rapid antigen testing if possible on campus. If not possible, the University will provide transportation to the voluntary testing site as necessary. 13. The University will provide information on local vaccine availability upon request. Workload 14. No instructor will be required to teach a section including both remote and in-person students. If a faculty member is asked to do so by any official of WWU (including but not limited to Deans, Chairs, Academic Program Directors, the Office of Student Life, and the Disability Access Center), and agrees, then the faculty member will be paid 50% of the usual overload rate, i.e. 1/72 of their academic year salary per credit hour.  15. Additional compensation for any additional scenarios not mentioned here will be determined by discussion between the appropriate Dean / Provost’s Office / faculty member and UFWW and any agreement will apply to all significantly similar situations.  Post Tenure Review 16. Upon request, tenured faculty scheduled for post-tenure review in the following academic years can opt for a one-year extension: PTR scheduled for AY 2024-2025 may be postponed to AY2025-2026PTR scheduled for AY 2025-2026 may be postponed to AY2026-2027Tenured faculty should submit their requests for postponement to their department chair, college dean, and the Provost in the year prior to their scheduled review.<a name="m_1416328362406531898__ftnref1" style="color: #222222;" title="">[1]</a><div>  <hr align="left" size="1" width="33%" /><div id="m_1416328362406531898gmail-ftn1"><a name="m_1416328362406531898__ftn1" style="color: #222222;" title="">[1]</a> This provision extends that in the second COVID MOU, signed 15 May 2020, which stipulated that: “Upon request, tenured faculty scheduled for post-tenure review in the following academic years can opt for a one-year extension:  PTR scheduled for AY 2020-21 may be postponed to AY 2021-22 PTR scheduled for AY 2021-22 may be postponed to AY 2022-23 PTR scheduled for AY 2022-23 may be postponed to AY 2023-24 PTR scheduled for AY 2023-24 may be postponed to AY 2024-25” ---</div></div></div><a href="">Unsubscribe »</a>

UFWW Message: Reminders Re: Winter MOU

Greetings Colleagues, I write to briefly remind you of some of the provisions of the Winter 2022 MOU between UFWW and WWU that may be helpful as the campus returns to a higher level of face-to-face activity within the context of the ongoing pandemic. Faculty who wish to move a hybrid or face-to-face class online for less than two weeks of the Winter Quarter may do so without requesting permission, though we encourage faculty to communicate clearly with your students and your chair about this change in order to reduce disruptions.  Faculty who have emergent issues that require them to move their course online for the quarter can request permission in-line with the provisions in the MOU, either through HR or through the Provost’s Office.  Vaccination data is available for your courses through your chair or director and the mask mandate remains in effect for all indoor spaces on campus.  I know these are challenging and dynamic circumstances under which we are all laboring. UFWW Message: CBA Working Groups — Nominations Open

Greetings Colleagues,The United Faculty of Western Washington seeks nominees to serve on two working groups created by our latest Collective Bargaining Agreement: a Senior Instructor Merit Raise working group and a Compression & Equity Formula working group.Any member of UFWW may nominate themselves or another member for these bodies. UFWW Exec will empanel the groups in January 2022 with the expectation that all their work will be complete by June 15, 2022. The Senior Instructor Merit Raise working group will have equal representation from UFWW and management. This group will author a series of recommendations to be forwarded to both bargaining teams for consideration during the next bargain. Nominations should be sent to UFWW VP Kirsten Drickey at <a href="mailto:KDrickey@PROTECTED" target="_blank">KDrickey@PROTECTED</a>.The Compression & Equity Formula working group will work towards mutual agreement with management about the content of <a href="https://www.ufww.org/bufww/wp-content/uploads/2021/11/21_23_CBA.html#bookmark639" target="_blank">Appendix D</a>, which contains the formula for determining Compression and Equity adjustments. The group will author revisions to Appendix D that will go into force for the September 2022 Compression and Equity adjustments. Recommendations of the task force will be forwarded to the parties respective bargaining teams for consideration during negotiations for a successor agreement. 22.2.1 An amount equal to one-half percent (0.50%) of the actual salaries paid to faculty members in the bargaining unit in 2021-2022 shall be distributed as of September 16, 2022 as salary increases to selected faculty effective at the beginning of the academic salary schedule. UFWW Message: Information on Paychecks and Winter Warmth Event

Greetings Colleagues,I'm writing today with two pieces of information.First, I'd like to provide you with some information about how you will see the effects of the newly ratified CBA in your November 10th paychecks. The new CBA provides for a 3% compensation increase for all faculty. This increase will be reflected in this week's paycheck in three ways: 1. You should see your normal wage payment increase by 3%.2. You should have a separate line item as a result of making the 3% retroactive to March 16. This amount will be 3% of your gross wages from the period of March 16 to September 15th (September 7th for chairs). This will be the larger of the two separate line items. 3. You should have a separate line item as a result of the retroactive payment for the 3% increase mentioned in item 1. This represents the 3% wage increase that would have been part of your two October paychecks. This retroactive payment goes to September 16th (September 8th for chairs). UFWW Message: Updates on Contract and Election

Greetings Colleagues,It's my pleasure to be able to write this email to you with two pieces of good news.First, I am happy to report UFWW members voted overwhelmingly to ratify the tentative agreement. This morning, Matt Roelofs (Chair of the UFWW Bargaining Team) and I visited the Board of Trustees meeting, where the Board voted to ratify the agreement as well. Following that vote the new CBA was signed by myself and President Randhawa and is now officially in place. The CBA is posted to the website as a searchable PDF.Thank you to everyone for their engagement with this process and thank you, especially, to the bargaining team who worked tirelessly over more than 20 months to get us to this point. I cannot express enough how deeply I appreciate your work and commitment to our faculty.Second, I am also happy to report that Dr. Desireé Cueto will be joining the UFWW executive board beginning immediately. The university will provide all available data on: (1) real-time monitoring of supply air and exhaust rates on all air handlers to ensure that ASHRAE standards for supply air are achieved, (2) the approximately 130 CO2 monitoring points in building supply air systems to ensure air provided to large sections of buildings contains sufficient outside air (OSA), and (3) the approximately 100 CO2 monitoring points in individual lecture halls and GUC’s to verify that the overall ventilation strategy is effective. This data will be provided by September 1, 2021 (via a webpage or email) and will be updated if the ASHRAE  recommendation is not met. The University will continue the use of MERV 13 air filters where system design and operating capacity allows and complete routine scheduled maintenance of all HVAC systems to ensure proper operation. Any building or room that falls below the ASHRAE recommendations will be taken offline or marked as for limited use. For buildings without supply air systems, the University will implement site-specific solutions within one week.</li><li style="text-align: justify;">The University will provide faculty with vaccination rate information for their classes 1 week prior to the first day of class and will update that information if it changes during the course of the quarter.</li><li style="text-align: justify;">Faculty will not be required to clean / disinfect rooms or elements of instructional spaces. The University will follow all health guidance and best practices with regards to cleaning and sanitation.</li><li style="text-align: justify;">Faculty will have access to their workspaces even if they teach remotely, assuming state guidance permits. </li><li style="text-align: justify;">The University will provide supplies and equipment including disposable masks, disinfectant, and disinfectant wipes in departmental spaces and classrooms. These materials will be restocked as needed upon notification.</li><li style="text-align: justify;">The University will notify faculty of positive cases of COVID-19 in their classes within 24 hours of receiving notification. </li><li style="text-align: justify;">The University will make COVID-19 testing available on a voluntary basis to vaccinated faculty, including rapid antigen testing if possible on campus. If not possible, the University will provide transportation to the voluntary testing site as necessary.</li><li style="text-align: justify;">The University will provide information on local vaccine availability upon request.</li><li style="text-align: justify;">The University will provide faculty with template language to include in course syllabi informing students about the policies and procedures in place for COVID safety in Winter and Spring 2022. This language will be sent to faculty via email one week prior to the start of the quarter. </li></ol>Workload<ol start="11"><li style="text-align: justify;">No instructor will be required to teach a section including both remote and in-person students. If a faculty member is asked to do so, whether for programmatic or accommodation reasons, and agrees, then the faculty member will be paid 50% of the usual overload rate, i.e. 1/72 of their academic year salary per credit hour. </li><li style="text-align: justify;">Additional compensation for any additional scenarios not mentioned here will be determined by discussion between the appropriate Dean / Provost’s Office / faculty member and UFWW and any agreement will apply to all significantly similar situations. </li></ol>Evaluations<ol start="13"><li style="margin-bottom: 0in; margin-right: 0in; margin-top: 0in; text-align: justify;">During Winter and Spring 2022, faculty will continue to provide opportunities for students to complete evaluation for all sections. However, due to the continued disruptions caused by the COVID-19 health crisis, inclusion of these evaluations in teaching portfolios of all faculty for non-tenure track review, probationary review, tenure and promotion, and post-tenure review remains optional. Evaluations that are included in teaching portfolios will have no negative impact on the outcome of the review in light of the most exceptional conditions under which they were conducted. (See Section 7.7.2.1 of the CBA). </li></ol>Non-Tenure Track Faculty Review<ol start="14"><li style="margin-bottom: 0in; margin-right: 0in; margin-top: 0in; text-align: justify;">For AY2021-2022, annual reviews for Instructors are optional. The choice to be reviewed is up to the instructor and postponed reviews will have no impact on renewal. For those choosing to be reviewed this year, timelines may be adjusted as necessary by each college, as long as the review concludes by June 15th. </li><li style="margin-bottom: 0in; margin-right: 0in; margin-top: 0in; text-align: justify;">For AY2021-2022, reviews are required for Senior Instructors in the final year of their contract per Section 8.1.3.3 of the CBA. Timelines may be adjusted as necessary by each college, as long as the review concludes by June 15th. </li></ol>Tenure Review<ol start="16"><li style="margin-bottom: 0in; margin-right: 0in; margin-top: 0in; text-align: justify;">CBA Section 7.7.1.1 states, “Faculty shall be evaluated for tenure not later than the sixth Fall Quarter of service (or as amended by extensions...).” In two previous MOUs, all probationary faculty members hired before June 16, 2021, were granted a one year extension. In addition to that group, all current probationary faculty members who start between June 16, 2021, and June 15, 2022, will also receive a one year extension to their original tenure review date. This does not prohibit faculty from applying for tenure and promotion earlier than their adjusted tenure review date “if they have established a record of accomplishment that meets department standards for teaching, scholarship, and service, based upon their annual probationary reviews” (see CBA Section 7.7.1.2). </li></ol>Professional Development Funds<ol start="17"><li style="text-align: justify;">Any unused 2019-2020 professional development funds from CBA Section 22.9.1 will rollover and be used to fund additional professional development in 2022-2023.
